These Terms of Service (“Terms”) govern your access to and use of the Trading Hearts platform, websites, and content-publishing tools (the “Service”), operated by Trading Hearts Productions LLC (“Trading Hearts,” “we,” “us,” or “our”), including tradinghearts.com and tradinghearts.productions. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Trading Hearts is a living knowledge and entertainment platform featuring original, character-led stories, videos, and history, together with tools that help authorized users create, manage, and publish content — including to connected social media accounts.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service or to accept these Terms on behalf of an organization.
You are responsible for maintaining the confidentiality of your access credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
You retain ownership of content you lawfully upload or create (“Your Content”). You grant Trading Hearts a limited license to host, process, and transmit Your Content solely to operate the Service and to perform the publishing actions you approve. You represent that you have the rights necessary to submit Your Content and to authorize its publication.
The Trading Hearts name, brand, the 28 custodian characters, and all associated stories, artwork, video, and other materials are the original works and intellectual property of Trading Hearts / Marques de Casa Hermosa LLC, protected by applicable law. Except as expressly permitted, you may not copy, reproduce, distribute, or create derivative works from them without our prior written consent.
The Service integrates with third-party platforms (including Meta/Instagram/Facebook, TikTok, X, LinkedIn, YouTube, and PayPal). Your use of those integrations is subject to the respective third party’s terms and policies. We are not responsible for third-party services.
If you purchase a subscription or product, payments are handled by our third-party processor (PayPal). Fees, billing terms, and any refund conditions will be disclosed at the point of purchase.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, Trading Hearts will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or relating to your use of the Service.
You agree to indemnify and hold harmless Trading Hearts from claims and expenses arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or where necessary to protect the Service or others. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the United States and the State in which Trading Hearts Productions LLC is organized, without regard to conflict-of-laws principles.
We may update these Terms from time to time. The updated version will be posted at this URL with a revised “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
